Legal Risk Management and Asian Arbitration Trends Dominate the Discussion at the Litigation Asia Summit

The marcus evans Litigation Asia Summit, APAC’s leading event for in-house legal counsel, took place from May 20th to 22nd at the Marina Bay Sands, Singapore. The programme covered a range of corporate legal challenges from enterprise-wide risk management to best practices in IP litigation.

As the West grapples with severe economic issues, a growing number of global investors and businesses are moving east. This influx of industry, coupled with a rise in home grown Asian innovation, brings increased legal challenges. A robust legal system is crucial to any emerging market and as Asian markets mature, education and corporate benchmarking will be key drivers for building a world-class legal industry in the region.

Wockhardt’s head of legal, Debolina Partap illustrated the greater global context for Asia’s in-house counsel during a pertinent presentation on implementing effective litigation management under stressed corporate conditions. As one of the first speakers at the summit, it was clear early on that strong compliance and risk assessment systems are essential to identifying and resolving red flag issues before they become devastating litigation cases.

Due to the high cost of litigation, arbitration is gaining ground in the region and was a major focus at the summit. One of the most highly anticipated sessions was the arbitrator’s forum which gathered leading perspectives from the region’s foremost arbitration centres for a candid discussion of challenges and solutions in this area. Expert speakers from the HKIAC, SIAC, KLRCA and CIETAC Tianjin Economic & Financial Arbitration Center shared behind-the-scenes insights in an interactive discussion moderated by Kim Kit Ow, director for arbitration and ADR at ICC Asia.

This forum provided a unique opportunity for the delegation to engage directly with the arbitrators on hot-button issues such as the increasing cost of arbitration, arbitrator selection and the most important imparts for effective enforcement of the arbitral award. As the gap between outcome and implementation continues to pose a challenge, award enforceability was an established focus at the event. Enforceability was explored in greater detail during a forum centring exclusively on the adequate preparation of arbitration agreements.

The importance of being proactive in in-house legal activities was also a consistent theme and was repeatedly emphasised by event speakers. Peterson Tien, GC and vice president at Chimei Innolux stressed the importance of building a comprehensive intelligence database to track risks. He also discussed the importance of law firm management to effectively control costs and in-house resources. Asset protection is of course a major issue for every company in the region and speaker S Ramaswamy, GC, JCB India provided pragmatic solutions for building, managing and defending the corporate IP portfolio.

Ramaswamy also joined the concluding discussion on gauging the impact of diverse customs for success across Asian jurisdictions. Possibly the most elusive of industry challenges, this forum dissected the complexities of sourcing local legal expertise, gauging jurisdictional standards and increasing the chances of favourable outcomes in unfamiliar markets.
